HOLIDAY RENTAL CONTRACT

Please read the terms and conditions of the rental contract before signing. You are entering into a binding contract with the Owner of the holiday property you are intending to book. By signing the booking form you have legally accepted the Terms & Conditions of rental below. Upon the Owner issuing a holiday confirmation advice for the property, a legally binding contract shall exist between the Holidaymaker & the Property Owner subject to the following booking conditions.

Owners: The legal Owners.

Agent: A person or company appointed by the Owner to rent or manage the property for holiday purposes.

Owners: The legal Owners.

Customer: The person reserving the Property for the Period.

Property: The property known as Beau Jardin Villa, Bengal, Discovery Bay, St Ann, Jamaica.

Period: The period of time specified in the Booking Form for which the Customer is to occupy the Property for holiday purposes.

Booking Form: Such form or document whether in writing, printed or electronic form produced by the Owners/Agent shall be for the purpose of recording the particulars of the Customer, Period of rental and any other relevant or desired terms relating to the occupation of the Property for holiday purposes. (In these conditions words importing the singular shall include the plural and vice versa. Words importing one gender shall include any other gender). Where the Customer comprises more than one person the liability of all such Customers shall be joint and several. The person who signs/confirms the Booking on behalf of the Customer warrants that he has full authority and power to accept these terms and conditions on behalf of himself and any other persons comprising the Customer.

Holiday Confirmation: Upon issuing a holiday confirmation advice for the property to the Customer, a legally binding contract shall exist between the Customer and the Property Owners.

Formation of Contract: The Contract is formed on receipt of a deposit of 25% within 7 days of the holiday booking.  The balance will be due 42 days prior to arrival at the Villa, or as agreed by the owner. We also require a prepaid damage deposit of [US $300 or £200] which will be returned to you after departure as long as no damage has occurred to the house or its contents.

Holiday & Personal Insurances: The booking of Beau Jardin Villa is non refundable so it is advisable to purchase travel insurance before making the final payment.

We would advise you to take out holiday insurance to cover any eventualities that may result in you having to cancel your holiday. We strongly suggest that you take out your own holiday insurance to cover any losses, accidents, damage, injury, expense or inconvenience whether to person or property which may arise out of or in connection with the period.

Arrival and Departure: Arrival shall be from 2pm on the first day and departure shall be at 12 noon on the last day. If you are travelling late evening the time of departure may be extended on agreement with the owner.

During the Period of Rental: The Customer shall not allow the property to be occupied by more persons than the maximum of 6 people, plus up to two children under twelve. Any additional occupancy beyond that agreed at the time of booking will need approval from the Owners.

Upon giving notice the Owners (or their representative) shall have the right to enter the property at reasonable times during the day (save in the case of emergency) for the purposes of inspection and repair of the property and its equipment, fittings and contents. The Customer shall occupy the property for holiday purposes and no other.

Customer obligations: 1) To pay for any loss or damage to the property, however caused (reasonable wear and tear excluded), 2) To keep the property and all furniture, fittings and effects, in or on the property, in the same state of repair and condition as the commencement of the Period, and to leave the property in a reasonable state of cleanliness and general order. The Owner will be entitled to make an additional charge to the Customer as a result of the property being left in a condition which requires special cleaning or repair. The property is provided with air conditioning for your comfort, but the Customer is reminded that excessive/improper use of the equipment causing non standard repairs and high electrical bills will result in additional cost to the Customer.

 

Items and Services Provided: Beau Jardin Villa aims to provide a property where customers will feel welcome and comfortable.  Crockery, cutlery, bedding, bath and pool towels will be provided as well as a hair dryer.   Please bring beach towels and personal toiletries with you as required.  Bed linen will be changed twice a week.   Please let us know if you require Internet service. Satellite television is provided as well as DVD/CD player and radio. There is a telephone for local calls; phone cards are readily available and can be bought locally by those who wish to make long distance or international calls. WiFi internet service is provided free of charge.

 

Discrepancies: Whilst the Owners take all reasonable steps to ensure the accuracy of the brochure, website and any illustrated materials produced in relation to the property its facilities and surroundings, no liability for errors or omissions is accepted. Distances and dimensions are approximate. No liability shall attach to the Owners for the consequences of the acts or omissions of persons or events outside their influences or control. In the event of any discrepancies between these booking conditions and the contents of the brochure, website and illustrated materials these booking conditions shall prevail.

Complaints: To enable any complaint to be investigated and an action considered, complaints must be taken up with the Owners in writing within 7 days of the last date of rental.

Rental:If for reasons beyond the control of the Owners, the property is not available for the Period, the Owners will refund in full all monies paid and be under no other liability.

Restrictions: No Pets are accepted at the property and no smoking is allowed in the villa.

Amenities: The use of amenities where offered, such as swimming pool and beach are entirely at the User’s risk and the Owner will not accept responsibility for loss or damage to the Customer’s belongings, personal injury or loss of life.
